Terms of Service

1. Acceptance and eligibility

1.1 These Terms of Service ("Terms") are a legally binding agreement between you and Travelfall Technologies Private Limited, a private limited company registered in India under CIN U62013UT2026PTC020981, with its registered office at C/O Dhruv Pant, Tipola, Gaon, Kherana Road, Ranikhet, Almora, Almora- 263645, Uttarakhand, India ("VoiceRoam," "we," "us," or "our").

1.2 By creating an account, downloading the app, or using any part of the VoiceRoam service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use VoiceRoam.

1.3 Account Eligibility & Age Warranty. By creating an account or using our services, you explicitly represent and warrant that you are 16 years of age or older. VoiceRoam is strictly intended for users who meet or exceed this age threshold. If you are under 16 years of age, you are strictly prohibited from creating an account or submitting personal data to the platform.


2. Account terms

2.1 To use most features of VoiceRoam, you must create an account using your email address, or by signing in with Apple or Google. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

2.2 You agree to provide accurate information when creating your account. You may use any display name you choose; we do not require your legal name.

2.3 You may not create an account on behalf of another person, share your account credentials with others, or operate multiple accounts for the purpose of circumventing these Terms or any restrictions we apply. You are strictly prohibited from buying, selling, hoarding, leasing, or renting user accounts, display names, or unique operational handles for commercial gain or speculative purposes.

2.4 You can delete your account at any time through the app settings or through our website. Account deletion is permanent and irreversible. While your active profile, functional credentials, and licensing options are immediately deactivated upon processing, you acknowledge that residual data fragments, system logs, and data slices will naturally persist within our encrypted offline backup volumes, server caches, and secure archives until standard data-clearing infrastructure cycles naturally overwrite them, as detailed in our Privacy Policy.

2.5 We may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in activity that is harmful to other users or to VoiceRoam, or used the service in a way that exposes VoiceRoam to legal liability. Where possible, we will provide notice before taking action, but we reserve the right to act immediately where the violation is severe or ongoing.


3. What VoiceRoam provides

3.1 VoiceRoam is an AI-powered, self-guided audio tour platform available on iOS and Android. The app allows you to browse, purchase, and listen to audio tours at locations across supported cities and regions. Core features include Pause & Ask (an AI-powered question and answer feature that accepts text and photo input), smart geofencing for location-triggered audio, offline maps and scripts for use without an internet connection, and a multilingual engine for in-app translation.

3.2 The VoiceRoam marketing website at www.voiceroam.com is informational only. It does not offer user accounts, purchases, tour playback, or any product functionality. These Terms apply to the website only to the extent that you interact with it (for example, signing up for our newsletter).

3.3 We aim to keep VoiceRoam available and reliable, but we do not guarantee uninterrupted or error-free service. Tours depend on GPS accuracy, device capability, network conditions, and other factors outside our control. Offline features depend on the user downloading the relevant content packs in advance.

3.4 Accessibility. We aim to design and develop VoiceRoam in alignment with WCAG 2.1 Level AA accessibility standards. The app includes accessibility features such as haptic feedback, a greyscale mode, and the ability to change text size. Accessibility is an ongoing effort and we may not yet meet every standard across all features. If you encounter an accessibility barrier or have feedback on how we can improve, please contact us at dhruv.pant@voiceroam.com. We welcome all input and will work to address reported issues.


4. Content nature, AI disclosures, and limitations

4.1 How our content is created

VoiceRoam's tour scripts are initially drafted using artificial intelligence and then reviewed, edited, and approved by human writers before publication. The voices you hear are generated using text-to-speech technology. They are synthetic and are not recordings of real people. Pause & Ask responses are generated in real time by AI based on your question and optional photo input.

All content delivered through VoiceRoam, whether through tour narration or Pause & Ask, is AI-assisted. While we take care to ensure quality through human review of tour scripts, we do not guarantee the factual accuracy, completeness, or reliability of any content. VoiceRoam content is intended for entertainment, cultural exploration, and general informational purposes. It should not be relied upon as an authoritative academic, historical, or factual reference. You use all content at your own discretion and judgment.

4.2 AI accuracy and limitations

AI-generated content, including Pause & Ask responses, may contain factual errors, outdated information, culturally insensitive interpretations, or statements that are incomplete or misleading. Human-reviewed tour scripts undergo editorial checks, but even reviewed content may contain inaccuracies. Pause & Ask responses are generated in real time without human review and carry a higher risk of error.

In particular, you should never rely on AI-generated responses for safety-critical information, including but not limited to structural safety of buildings or infrastructure, safe routes for walking or transit, opening hours or operational status of venues, medical or emergency information, or legal or regulatory guidance at any location. Always verify such information independently through official sources.


5. Pause & Ask and user-uploaded content

5.1 How Pause & Ask works

Pause & Ask allows you to type a question and optionally upload a photo. Your question and photo are transmitted through our backend server to a third-party AI service to generate a response. No account identifier or personal information beyond your question and photo is included in the request sent to the AI provider.

5.2 License you grant us for uploaded content

By uploading a photo or submitting a text prompt through Pause & Ask, you grant VoiceRoam a limited, non-exclusive, royalty-free license to transmit the photo and text to our AI service provider for the sole purpose of generating a response to your query, to store any uploaded photo in our cloud infrastructure for a period of up to 30 days for service quality and troubleshooting purposes, and to delete the photo automatically at the end of that period or immediately upon your account deletion, whichever comes first.

This license is strictly limited to the purposes stated above. We do not use your photos or text prompts for advertising, marketing, training AI models, or any other purpose. We do not share your content with anyone other than our AI service provider in the context of answering your query. This license terminates when the photo is deleted. Text prompts are processed transiently and are not stored in our systems.

5.3 Your responsibilities when using Pause & Ask

You represent and warrant that any photo you upload is either taken by you or that you have the right to use and share it, and that any text prompt you submit is your own original input. You agree not to:

If you submit content that violates these terms, we may delete it without notice and, in serious or repeated cases, suspend or terminate your account.


6. Purchases, pricing, and refunds

6.1 What you can purchase

VoiceRoam currently offers the following purchase options:

6.2 Tour Pass Mechanics and Credit Redemption

When you purchase a Columbus or Marco Polo Pass, you receive a set number of tour credits to redeem within a fixed time window displayed at the time of purchase. Passes are single, fixed-term purchases and do not auto-renew. VoiceRoam does not currently offer free trials or auto-renewing subscriptions.

Redeemed Tours: Each time you select a tour using a pass credit, it becomes permanently yours, with the exact same offline download and access rights as an individually purchased tour.

Expired Credits: Any credits you do not redeem before your pass timeframe expires are permanently forfeited. Unredeemed credits do not carry over and are not refundable.

6.3 How payment works

All purchases are processed through Apple's App Store (for iOS) or Google's Play Store (for Android). Apple and Google act as the merchant of record and handle all payment processing. We never receive, store, or have access to your payment method information. By making a purchase, you agree to the applicable payment terms of Apple or Google in addition to these Terms.

Prices are displayed in your local currency as determined by Apple or Google and include applicable EU VAT and other taxes.

6.4 Right of withdrawal (EU Consumers)

Under EU consumer protection law, you generally have a 14-day right of withdrawal for digital content purchases. However, because VoiceRoam delivers digital content immediately upon purchase, you acknowledge and agree that by initiating the download or playback of any tour content, you consent to the immediate delivery of the digital content and you thereby waive your 14-day right of withdrawal.

6.5 Digital Content Conformity

Under the EU Digital Content Directive, digital content must conform to its description and function as expected. If an acquired tour fails to play in your selected language or suffers from reproducible technical defects, you have the right to request that conformity be restored (e.g., a technical fix or replacement tour). If conformity cannot be restored, you may be entitled to a proportionate price reduction or a refund through the applicable app store. Please note that AI-generated factual inaccuracies do not constitute a lack of conformity under these Terms.

6.6 Content Removal and Catalog Changes

We reserve the right to remove tours from the active catalog due to licensing disputes, legal requirements, or persistent inaccuracies. If a tour you have already acquired is permanently removed, we will offer you a replacement tour of comparable value from the existing catalog or support a proportionate refund request through the applicable app store.

6.7 Refunds outside the right of withdrawal

Refund requests made through Apple or Google's own refund processes are governed by their respective policies and are handled directly by them. We do not control those decisions or process refunds directly. However, we will support your refund request to Apple or Google if you experience a significant technical issue that prevents you from accessing your purchased content, or if you were charged incorrectly due to a billing error. 7. Intellectual property

7.1 Our intellectual property

All content and materials in VoiceRoam, including the curated arrangement of tour scripts, human-edited and editorially reviewed text, synthetically generated audio narrations, app design, user interface elements, graphics, logos, trademarks, and the underlying software, are owned by VoiceRoam or our licensors and are protected by copyright, trademark, and other intellectual property laws. The selection, coordination, arrangement, and editorial enhancement of content constitute protectable creative works regardless of whether individual AI-generated elements are independently protectable under copyright in all jurisdictions.

Your purchase of a tour or access pass grants you a personal, non-exclusive, non-transferable, revocable license to access and listen to the content through the VoiceRoam app for your personal, non-commercial use. This license does not transfer ownership of any content to you.

7.2 What you may not do with our content

You may not copy, reproduce, distribute, publicly perform, or publicly display any VoiceRoam content. You may not record, screen-capture, or otherwise extract audio or text from the app for redistribution. You may not use any VoiceRoam content for commercial purposes, including but not limited to incorporating it into your own tours, products, services, or publications. You may not modify, adapt, translate, or create derivative works based on our content, except for personal notes taken during a tour for your own private use. You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices.

7.3 Your content

You retain ownership of any photos you upload and text you submit through Pause & Ask. The limited license you grant us is described in Section 5.2 and is restricted to the specific purposes stated there.


8. Acceptable use

8.1 You agree to use VoiceRoam only for its intended purpose as a personal audio tour and information service. You agree not to:

8.2 We reserve the right to investigate potential violations of these acceptable use terms and to take appropriate action, including suspending or terminating your account, removing content, or reporting activity to law enforcement where we believe it is necessary.

8.3 Physical safety. VoiceRoam is an audio tour app designed for use while walking through real-world environments including busy city streets, uneven terrain, construction areas, and other locations that may present physical hazards. You are solely responsible for your own safety and awareness of your surroundings at all times while using the app. Do not use VoiceRoam in a way that distracts you from traffic, obstacles, changes in terrain, or other hazards. Do not use the app while operating a vehicle, bicycle, or any other mode of transport. VoiceRoam does not assess or guarantee the physical safety of any tour route. Local conditions including traffic patterns, construction, weather, and terrain may change at any time. You follow any route or direction at your own risk and should always prioritize your personal safety over following a tour.


9. Partner listings and third-party links

9.1 The VoiceRoam app may display listings for third-party partners, including museums, cultural attractions, hotels, and tourism services. Some of these listings involve commercial arrangements in which VoiceRoam receives referral commissions or other compensation. Partner listings that are part of a commercial arrangement will be clearly marked within the app. When you see a listing marked with a commercial indicator, it means VoiceRoam may earn a commission if you visit or transact with that partner. The presence of a commercial arrangement does not affect our editorial decisions about which partners to feature, and we are transparent about these relationships so you can make informed choices.

9.2 When you tap a partner listing, you leave VoiceRoam and are directed to a website or service operated by that third party. That third party's own terms of service and privacy policy govern your interaction with them. We may include a referral identifier in the outbound link, but this does not identify you personally.

9.3 We do not control, endorse, or assume responsibility for the content, accuracy, practices, or availability of any third-party website or service. Your decision to interact with a partner is entirely your own, and any transaction or relationship you enter into with a third party is solely between you and that third party.


10. Availability, modifications, and discontinuation

10.1 We may update, modify, or change any aspect of the VoiceRoam service at any time, including adding or removing features, tours, cities, or supported languages. Where changes materially affect your existing purchased content (for example, removing a tour you have already purchased), we will make reasonable efforts to provide advance notice and, where appropriate, offer an alternative or refund.

10.2 We may temporarily suspend access to the service for maintenance, updates, security, or operational reasons. We will endeavor to provide advance notice of planned downtime where practicable, but emergency maintenance may occur without notice.

10.3 We reserve the right to discontinue the VoiceRoam service entirely, in whole or in part, at any time. If we permanently discontinue the service, we will provide at least 30 days' notice and support refund requests through the applicable app stores for any active tour passes with unredeemed credits, calculated proportionately to the unused credits. For acquired tours (whether individually purchased or pass-redeemed), we will make reasonable efforts to provide continued access for as long as technically feasible, or support fair refund requests through the applicable app stores.


11. Limitation of liability

11.1 This section does not exclude or limit our liability for anything that cannot be excluded or limited under applicable law. In particular, nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intentional misconduct or gross negligence, or for any other liability that mandatory applicable law does not permit us to exclude or limit.

11.2 Subject to Section 11.1, and to the fullest extent permitted by applicable law:

11.3 You acknowledge that the content in VoiceRoam, including tour narration and Pause & Ask responses, is generated with the assistance of artificial intelligence and may contain errors, inaccuracies, or culturally sensitive material. You use all content at your own discretion. We are not liable for any decisions you make, actions you take, or emotional distress you experience based on content provided through the service, to the extent that such liability can be excluded under applicable law.

11.4 We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials, your reliance on VoiceRoam content as an authoritative factual source, third-party services or websites you access through links in the app, GPS inaccuracies, network failures, or device-specific issues that affect your experience, or your physical safety while following tour routes. The physical safety terms in Section 8.3 apply in full. You remain responsible at all times for your own awareness of your surroundings, traffic, terrain, and local conditions.


12. Indemnification

12.1 You agree to indemnify, defend, and hold harmless VoiceRoam, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with your breach of Section 8 (Acceptable Use), your breach of Section 5.3 (your responsibilities when using Pause & Ask), your violation of any applicable law or the rights of any third party in connection with your use of the service, or content you upload or submit through Pause & Ask that infringes the intellectual property or privacy rights of a third party. VoiceRoam agrees to provide you with prompt written notice of any such claim or legal action. You will not be responsible for any indemnification losses, settlements, or expenses directly resulting from a delay in notice by VoiceRoam that materially prejudices your ability to defend, answer, or mitigate the claim.

12.2 This indemnification obligation does not apply to the extent that the claim arises from our own negligence, willful misconduct, or breach of these Terms.

12.3 This indemnification provision does not apply to you if you are a consumer and applicable law in your jurisdiction prohibits consumer indemnification obligations. In such cases, this section will not form part of your agreement with us.


13. Termination

13.1 You may terminate your agreement with us at any time by deleting your account through the app settings or our website. Upon account deletion, your license to use the service and access any purchased content terminates immediately.

13.2 We may terminate or suspend your account and access to the service immediately, with or without notice, if you breach any material provision of these Terms, if we are required to do so by law or a court order, if continuing to provide the service to you would create a legal liability for us, or if we discontinue the service as described in Section 10.3.

13.3 Upon termination for any reason, the following sections survive and continue to apply: Section 4 (Content nature, AI disclosures), Section 7 (Intellectual property), Section 8.3 (Physical safety), Section 11 (Limitation of liability), Section 12 (Indemnification), Section 14 (Governing law and dispute resolution), Section 17 (App Store provisions), and any other provisions that by their nature should survive termination.

13.4 Upon processing your voluntary account deletion, active server licensing access is immediately disabled. However, you acknowledge that system data fragments and archival records naturally persist in encrypted backup storage arrays until overwritten by standard system operational routines. Termination of your account does not entitle you to a refund for tours you have already acquired (whether through individual purchase or pass redemption) or for tour credits already redeemed under an active pass. Unredeemed tour credits on an active pass are forfeited upon voluntary account deletion and are not refundable. These limitations do not affect your rights under Section 6.4 (right of withdrawal) or Section 10.3 (service discontinuation).


14. Governing law and dispute resolution

14.1 Governing Law. These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

14.2 Dispute Resolution & Class Action Waiver. For disputes that do not involve an individual acting as a consumer under EU law, any dispute, claim, or controversy arising out of or relating to these Terms or the VoiceRoam service shall be submitted to the exclusive jurisdiction of the courts located in Uttarakhand, India. This exclusive jurisdiction clause does not override the mandatory consumer protections described in Section 14.3. To the fullest extent permitted by applicable law, you and VoiceRoam agree that any dispute resolution proceedings for non-consumer claims will be conducted solely on an individual basis and not in a class, consolidated, or representative action.

14.3 If you are a consumer habitually resident in the European Union, nothing in these Terms deprives you of the protection afforded by the mandatory provisions of the law of your country of habitual residence, as guaranteed by Article 6(2) of the Rome I Regulation (EC) No 593/2008. You also retain the right to bring proceedings in the courts of your country of habitual residence, as provided by the Brussels I Regulation (EU) No 1215/2012.

14.4 We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board or any equivalent alternative dispute resolution body. If you have a dispute with us, please contact us directly at dhruv.pant@voiceroam.com.

14.5 If you are accessing VoiceRoam from a jurisdiction outside the EU, these Terms are still governed by Indian law, but nothing in these Terms limits any mandatory consumer protections that apply to you under the laws of your own jurisdiction.


15. Geo restrictions

15.1 VoiceRoam is designed for and marketed to users in the European Union, beginning with Spain. Our services might not be available in a few countries, and we do not actively market or provide support in those jurisdictions.

15.2 The VoiceRoam app may not be published in the app stores of certain countries, and the VoiceRoam marketing website may be access-restricted in those jurisdictions. These measures may not be comprehensive. Users who access the app while traveling or through other technical means do so at their own discretion and should be aware that our service, support, and legal compliance framework is designed for our target markets.


16. General provisions

16.1 Severability. If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

16.2 Entire agreement. These Terms, together with the Privacy Policy and any purchase-specific terms presented at the point of sale, constitute the entire agreement between you and VoiceRoam regarding your use of the service. They supersede all prior agreements, communications, and understandings, whether written or oral, relating to the same subject matter.

16.3 Assignment. You may not assign or transfer your rights or obligations under these Terms to anyone else without our prior written consent. We may assign our rights and obligations under these Terms to a successor entity in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets, provided the successor agrees to be bound by these Terms.

16.4 Waiver. Our failure to enforce any right or provision of these Terms at any time does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us to be effective.

16.5 Force majeure. We are not liable for any failure or delay in performing our obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network outages, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
